Coretek 360

Terms of Service

Last updated on .

These Terms of Service ("Terms") are an agreement between you and Coretek Enterprises LLC, doing business as Coretek 360 ("Coretek 360," "we," "us," or "our"). They govern your access to and use of coretek360.com and the content, forms, and tools on it (collectively, the "Site").

Accessing or using the Site means you accept these Terms in full. We also encourage you to review our Privacy Policy, which describes how we handle personal data collected through the Site.

These Terms cover the Site only. IT asset disposition and related services, including pickups, data destruction, resale, and recycling, are provided under a written agreement, quote, or statement of work between Coretek 360 and the customer. Where such an agreement exists, it governs those services and takes precedence over these Terms.

If you are using the Site on behalf of a business, organization, or other legal entity, you represent that you have authority to act for that entity.

1. Use of the Site

You may use the Site to learn about Coretek 360 and its services, to request a quote, and to contact us. When you comply with these Terms, we grant you a limited, non-exclusive right to access and use the Site for those purposes.

You may not use the Site in violation of any applicable law; attempt to gain unauthorized access to the Site or the systems behind it; interfere with its security or operation; submit files that contain malicious code; use automated means to access the Site in a way that places an unreasonable load on it; or misrepresent your identity or your affiliation with any person or organization. You may not permit others to do any of the foregoing.

2. Eligibility

The Site is intended for businesses and organizations. You must have reached the age of majority in your jurisdiction or be at least 18 years old, whichever threshold is greater, to use the Site.

3. Information on the Site

The Site describes our services, processes, certifications, and the standards we work to. We aim to keep that information accurate and current, but it is provided for general information and may change without notice.

Nothing on the Site is an offer or a binding commitment to provide a service at a particular price, time, or place. A quote is binding only when Coretek 360 issues it in writing.

The scope of each certification we hold is stated on the certificate itself and in the directory of the body that issued it. Where the Site and a certificate differ, the certificate controls.

References on the Site to laws, regulations, and standards, such as HIPAA, GLBA, FERPA, PCI DSS, and NIST 800-88, are general information and are not legal or compliance advice. You are responsible for determining what your organization's obligations require.

4. Quote Requests and Submissions

When you submit a form on the Site, you represent that the information you provide is accurate and that you are authorized to share it, including any file you attach.

Do not include passwords, patient records, financial account numbers, or other sensitive personal data in a form or an attached file. An asset list should describe equipment, for example by make, model, quantity, and serial number.

Submitting a request does not create a service agreement and does not obligate you or Coretek 360 to proceed. We may contact you using the details you provide in order to respond.

5. Services Are Governed by Separate Agreement

Any service Coretek 360 performs is governed by the written agreement, quote, or statement of work for that engagement. That agreement, and not these Terms, sets out the scope of work, pricing, pickups and logistics, chain of custody, transfer of title to equipment, data destruction methods and reporting, warranties, and each party's liability.

6. Ownership

Coretek 360 and its licensors hold all right, title, and interest in and to the Site, including its text, design, images, software, and brand assets, and all related intellectual property rights. You may view the Site and share links to it. You may not copy, reproduce, or republish its content for commercial purposes without our written permission.

Certification marks and other third-party names and logos shown on the Site belong to their respective owners and are used to identify the certifications and standards they represent.

If you choose to submit feedback, suggestions, or ideas about the Site or our services, you grant Coretek 360 a perpetual, irrevocable, royalty-free license to use that feedback for any purpose without obligation to you.

7. Third-Party Sites and Content

The Site links to websites and displays content that other parties operate, such as certification directories, social media pages, embedded video, and Coretek Computers, a separate division of Coretek Enterprises LLC.

Your use of any third-party site or service is governed by that party's terms and policies. Coretek 360 has no control over and takes no responsibility for the availability, accuracy, or practices of third-party sites and services.

8. Communications

By submitting a form or subscribing to our newsletter, you agree that Coretek 360 may contact you by email or other channels about your request, our services, and, if you subscribed, news and updates.

You may unsubscribe from promotional communications at any time. Opting out of promotional messages will not affect messages about a request you have made or a service we are providing to you.

9. Modification of Terms

Coretek 360 reserves the right to update these Terms at any time. When we make material changes, we will provide notice by updating the "Last updated" date on this page or through another appropriate method.

Continuing to access or use the Site after updated Terms take effect constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the Site.

10. Changes to the Site

Coretek 360 may alter, limit, or discontinue any part of the Site at any time, whether temporarily or permanently, without prior notice. We may also restrict access to the Site for anyone who violates these Terms.

11. Privacy

Our Privacy Policy governs how Coretek 360 collects, uses, stores, and discloses personal data in connection with the Site. By using the Site, you acknowledge our data practices as described in the Privacy Policy.

12. Indemnity

You are responsible for your use of the Site and for any consequences arising from that use, to the fullest extent permitted by applicable law.

You agree to defend, indemnify, and hold harmless Coretek 360 and its affiliates, officers, directors, employees, contractors, agents, and representatives from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to your misuse of the Site, your breach of these Terms, your violation of any applicable law, or your infringement of any third-party rights.

13. Disclaimer of Warranties

The Site and its content are made available on an "as is" and "as available" basis, without warranties of any kind.

To the maximum extent permitted by law, Coretek 360 expressly disclaims all warranties regarding the Site, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, and any warranties arising from course of dealing or usage in trade.

Coretek 360 does not represent or warrant that the Site will operate without interruption or error, or that it will be free of security vulnerabilities or harmful components. This section applies to the Site. Any warranty for a service is stated in the agreement for that service.

14. Limitation of Liability

To the fullest extent permitted by applicable law, Coretek 360 and its affiliates, officers, employees, and agents will have no liability for any indirect, incidental, consequential, special, exemplary, or punitive damages arising from or related to these Terms or the Site, even if advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising under or related to these Terms or the Site will not exceed the greater of: (a) the total fees you paid to Coretek 360 under these Terms during the six-month period immediately preceding the event giving rise to the claim, or (b) one hundred U.S. dollars ($100).

This section applies to the Site. Liability for a service is governed by the agreement for that service.

15. Dispute Resolution

Please read this section carefully. It contains important provisions that affect your legal rights, including how disputes between you and Coretek 360 will be resolved.

Except for claims that qualify for small claims court, any dispute, claim, or controversy arising out of or relating to these Terms or the Site will be resolved exclusively through binding individual arbitration. Both you and Coretek 360 waive the right to a jury trial and the right to participate in any class, collective, or representative action.

Before initiating arbitration, the party asserting a claim must send the other party a written Notice of Dispute describing the nature of the claim and the relief sought. The parties agree to attempt to resolve the dispute informally for at least 30 days following delivery of the notice.

If informal resolution fails, arbitration will proceed before a neutral arbitrator under the then-current rules of the American Arbitration Association, as modified by these Terms.

16. Miscellaneous

These Terms, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and Coretek 360 with respect to your use of the Site and supersede all prior or contemporaneous agreements on the same subject.

You may not assign or transfer your rights or obligations under these Terms without the prior written consent of Coretek 360. Coretek 360 may freely assign these Terms and any rights granted hereunder.

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or severed to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

These Terms are governed by the laws of the State of North Carolina, without regard to conflict of law principles.

You consent to receiving communications from Coretek 360 in electronic form. For questions or legal notices, contact us at support@coretek360.com.

Your use of the Site must comply with all applicable export control laws, sanctions programs, and trade regulations.
